These Terms of Service ("Terms") govern your access to and use of the Cortex Trade platform and services ("Service") provided by Cortex Trade ("Cortex Trade", "we", "us"). By registering an account, clicking "Get Started", or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated by reference.
If you do not agree, do not use the Service.
Cortex Trade is a software platform that automates trading decisions using a multi-agent AI pipeline. It connects to your broker account (currently Capital.com) via your own API credentials, executes trades on your behalf according to rules and parameters that you configure, and provides analytics on trading activity.
Cortex Trade is a software automation tool. It is not a broker, a fund manager, an investment adviser, or a financial institution. All trades are executed in your name, on your behalf, using your own broker account and your own capital.
Important: Nothing on the Cortex Trade platform, in its communications, or in its AI-generated analysis constitutes financial advice, investment advice, trading advice, or any other form of advice. Cortex Trade is not licensed as a financial adviser, broker-dealer, or investment manager in any jurisdiction. AI-generated trade signals are automated outputs based on market data and are not a recommendation to buy or sell any financial instrument. You must make your own independent assessment of the suitability of any trade.
Before using automated trading, you should understand the risks involved and, where appropriate, seek advice from an independent, licensed financial adviser. See our Risk Disclosure for a full description of the risks.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:
We are not liable for losses arising from unauthorised account access where you failed to take reasonable precautions or failed to notify us promptly.
All paid plans include a 14-day free trial. No payment method is required during the trial. At the end of the trial period, your account will revert to a limited free tier unless you subscribe to a paid plan.
Subscription fees are charged in advance, either monthly or annually, via PayPal. Prices are listed on our Pricing page and may be changed with 30 days' notice to existing subscribers.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain full access until then. We do not issue refunds for partial billing periods unless required by applicable law.
Annual plans are billed as described on the Pricing page (monthly instalments or an upfront annual payment). Early termination of an annual plan does not entitle you to a refund of the remaining term unless required by law.
If a payment fails, we will notify you and allow a grace period before suspending access. You are responsible for ensuring your PayPal account remains in good standing.
You agree not to use the Service to:

Cortex Trade and its licensors own all intellectual property rights in the Service, including but not limited to software code, algorithms, AI pipeline design, templates, and documentation. These Terms do not grant you any right, title, or interest in the Service other than the limited licence to use it in accordance with these Terms.
You retain ownership of data you provide (e.g., your trading configurations). You grant us a limited licence to use that data to provide and improve the Service.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
We do not guarantee any specific financial outcome, profit, or win rate. Past performance of the AI pipeline in demo or live trading is not indicative of future results. Trading is inherently speculative, and you may lose all of the capital you deploy.
To the maximum extent permitted by applicable law, Cortex Trade shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of capital, loss of data, or business interruption, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising from or related to these Terms or the Service shall not exceed the greater of: (a) the fees you paid us in the 12 months preceding the claim, or (b) USD $100.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify and hold harmless Cortex Trade and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any trade executed on your behalf by the Service.
You may terminate your account at any time by deleting it from Account Settings. We may suspend or terminate your access immediately, without prior notice, if we reasonably believe you have violated these Terms or if we are required to do so by law.
On termination, your right to use the Service ceases immediately. We will retain data as described in our Privacy Policy. Upon request, we will provide you with a copy of your trade history in a machine-readable format within 30 days.
We may update these Terms from time to time. We will provide at least 14 days' notice of material changes by email and/or in-app notice before they take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription.
These Terms are governed by applicable law. In the event of a dispute arising from or related to these Terms or the Service, the parties agree to first attempt to resolve the matter informally by contacting wecare@pocketpass.app. If the dispute cannot be resolved informally within 30 days, either party may seek resolution through the courts or other dispute resolution mechanisms available in the applicable jurisdiction.
Nothing in this section limits your rights as a consumer under applicable mandatory consumer protection law.
